Deed Restrictions
1. All residential lots in this subdivision shall be for private single family residential purposes. No house trailer, modular homes, motor campers, camper trailer, garages, outbuildings or temporary structures shall be used as a residence, either temporarily or permanently.
2. No Lot shall be subdivided or its boundary lines changed, except with the prior written approval of the Developer.
3. No noxious or offensive trade or activity shall be conducted or permitted within Mayden Trace, which may be or become an annoyance or nuisance to the residents.
4. All vehicles (boats/tractors/etc.) shall be (parked/housed) behind residence or in a garage. Tractor–trailers, heavy farm equipment, immobilized vehicles, or any other use that would be unsightly is not permitted. This is to keep the street and frontages esthetically pleasing.
5. No more than two cats or dogs allowed per household. Fowl, livestock, or other animals are not permitted. No animals shall be raised for commercial use or sale. Outside pets shall be controlled by leash, pen or underground fence.
6. Fences or walls may not extend beyond the front corner of the residence. Fences shall be limited to 6ft maximum height.
7. No lot shall be used or maintained as a dumping ground, junk yard, or for the storage of garbage or other waste or hazardous substances. All lot owners will comply with Edmonson County Health Dept. and the Kentucky State Board of Health.
8. Each lot owner will keep appearance of lot acceptable to Developers.
9. Repairs from fire, storm or wind damage shall be preformed in a timely manner as determined by the extent of damage.
10. When construction or reconstruction is begun, work must be pursued diligently and completed within one (1) year.
11. All lots and common areas of Mayden Trace are subject to easements for electrical, water, telephone lines, television cables, and drainage easements. Above ground electric transformers, pedestals, telephone connection may be installed at appropriate points in any easement.
12. Construction plans and specifications including exterior materials must be approved by the developer prior to initiation.
13. Architectural design and exterior must keep in harmony with the surroundings, and preserve the natural setting.
14. The exterior building material of all structures shall be either brick, stone, drivit, stone veneer, natural or concrete “wood” siding or a combination. Vinyl or aluminum siding can be used to accent but must not be the main exterior material. All colors of exterior walls shall be subject to approval by Developer.
15. A residence shall have a minimum of one thousand four hundred (1,400) square feet of living space. Variances allowed with Developer’s approval.
16. Each owner is responsible for installing appropriate sized drainage tile and gravel to avoid damage to the road, ditch line, and grass.
i. Owners are financially responsible for damages done to the road during construction on their lot.
17. Detached garages or storage buildings will be permitted if design and exterior is in compliance with the main structure and esthetics of the natural setting. Only one detached building per structure is permitted unless written approval is granted by developer. Metal or pre-fabricated car ports are discouraged.
18. A $300.00 annual fee per lot will be collected for the maintenance of roads, common areas, entrance and paths with be assessed. Non-payment will lead to an additional 8% per annum from due date and a lien will be obtained on involved lot or lots.
19. Lot owners shall form an association when 50% of the lots are sold and shall take over the responsibility of maintenance of all roads, gates, and common areas.
